GPTube – Terms of Service

Welcome to GPTube (“we,” “our,” or “us”). GPTube provides an interface that allows users to interact with YouTube videos using large language models (LLMs) powered by Google Gemini, enabling dynamic, conversational experiences with video content.

By using GPTube, you (“you,” “user,” or “users”) agree to these Terms of Service (“Terms”). Please read them carefully before using the platform.

1. Acceptance of Terms

  • By accessing or using GPTube, you agree to be bound by these Terms and our Privacy Policy.
  • If you do not agree, you may not use the Service.
  • You also agree to comply with all applicable laws and regulations while using GPTube.

2. Eligibility

To use GPTube, you must:

  • Be at least 13 years old, or the minimum age required in your jurisdiction.

GPTube allows users to “chat” with YouTube videos through AI-generated conversations. GPTube does not host or store YouTube content and is not affiliated with Google LLC, YouTube, or its subsidiaries.

You acknowledge that:

  • GPTube merely interfaces with YouTube's public API to provide video data.
  • GPTube cannot guarantee the accuracy, completeness, legality, or reliability of any video content or AI-generated output.
  • All AI responses are generated by Google Gemini, and may contain errors, inaccuracies, or hallucinations. These responses should not be treated as factual or professional advice.

4. Accounts and Access

Certain features may require creating an account. You agree to:

  • Provide accurate and current information during registration.
  • Maintain the confidentiality of your credentials.
  • Accept full responsibility for all activity under your account.

GPTube reserves the right to suspend or terminate accounts at its sole discretion if it detects misuse, suspicious activity, or violation of these Terms.

5. Subscription and Premium Features

GPTube may offer both free and premium tiers. Access to premium features may require a paid subscription.

All payments are processed through secure third-party providers. By subscribing, you authorize GPTube to charge your selected payment method in accordance with the plan you choose.

GPTube reserves the right to modify its pricing, plans, or features at any time without prior notice.

6. Acceptable Use

You agree not to:

  • Use GPTube to infringe on copyrights, trademarks, or other proprietary rights.
  • Attempt to bypass or interfere with GPTube's API, rate limits, or technical infrastructure.
  • Use GPTube to generate or distribute illegal, defamatory, hateful, or explicit content.
  • Misrepresent AI-generated responses as factual, human-generated, or endorsed information.
  • Engage in automated scraping, data extraction, or reverse engineering.

Violation of these rules may result in account suspension or permanent termination without notice.

7. Third-Party Services and Content

GPTube integrates with external services, including:

  • YouTube, through the YouTube Data API
  • Google Gemini, for AI-generated text processing

By using GPTube, you also agree to comply with:

  • YouTube's Terms of Service
  • Google's Terms of Service

GPTube has no control over third-party content or services and disclaims all liability arising from their use or availability.

8. Disclaimer of Warranties

GPTube is provided on an “as is” and “as available” basis, without warranties of any kind.

We make no representations or warranties, express or implied, regarding:

  • The accuracy, reliability, or completeness of AI-generated responses.
  • The uninterrupted or error-free operation of the Service.
  • Fitness for a particular purpose or merchantability.

You acknowledge that GPTube may experience downtime, maintenance, or changes at any time without liability.

AI-generated responses may be unpredictable and should not be relied upon for professional, academic, financial, or legal advice.

9. Limitation of Liability

To the fullest extent permitted by law:

  • GPTube, its owners, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • GPTube's total liability for any claim arising out of or related to your use of the Service shall not exceed the amount you paid (if any) for GPTube in the preceding twelve months.

This includes, without limitation, loss of profits, data, goodwill, or any damages resulting from:

  • Errors or omissions in AI-generated content;
  • Technical failures or service interruptions;
  • Unauthorized access to your data;
  • Third-party service disruptions (including YouTube or Google).

10. Indemnification

You agree to indemnify, defend, and hold harmless GPTube, its affiliates, and its personnel from any claims, damages, liabilities, or expenses (including attorney fees) arising from:

  • Your violation of these Terms;
  • Your misuse of the Service; or
  • Your infringement of third-party rights.

11. Modifications and Termination

We may, at our sole discretion:

  • Modify, suspend, or discontinue GPTube at any time;
  • Change these Terms without prior notice; or
  • Terminate your access for violations or misuse.

Your continued use after changes constitutes acceptance of the updated Terms.

All sections related to ownership, indemnification, disclaimers, and limitation of liability survive termination.

12. Intellectual Property

All intellectual property related to GPTube—including software, branding, design, and AI prompts—is owned by GPTube or its licensors.

You are granted a limited, non-exclusive, non-transferable right to access and use GPTube for personal use only. You may not copy, distribute, modify, or exploit GPTube's materials for commercial purposes.

You retain ownership of your own data but grant GPTube a license to process it solely to operate and improve the Service, as described in our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-law principles.

Any dispute arising from or relating to these Terms shall be resolved exclusively in a competent court within the United States.
